Terms & Conditions

These Terms and Conditions (“Terms”) form a binding agreement between you (“User,” “you”) and "Call My Creators" ("Call My Creators", “we,” “us,” or “our”) governing your access to and use of the "Call My Creators" mobile application, website, and related video calling services (collectively, the “Service”).

By creating an account, downloading the app, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not access or use the Service.

You must be at least 18 years old to create an account or use the Service. By using the Service, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into these Terms.

Accounts registered by “bots” or automated methods are not permitted and may be terminated without notice.

To access certain features, you must register for an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

"Call My Creators" may require identity or age verification for creators before enabling video call or payout functionality, and may suspend accounts pending verification.

"Call My Creators" enables “Fans” to book and join live video calls with “Creators.” Creators are independent users who set their own availability and, where applicable, per-minute or per-session rates, subject to any limits "Call My Creators" imposes.

"Call My Creators" acts as a platform that facilitates the connection and payment between Fans and Creators. We are not a party to, and do not control the content of, any call between a Fan and a Creator, except to the extent necessary to enforce these Terms and applicable law.

Calls may be subject to scheduling windows, cancellation policies, minimum call durations, and no-show fees, as described in the app at the time of booking.

You agree not to, and not to assist others to:

• Use the Service to harass, threaten, defame, or abuse any other user.
• Upload, transmit, or display during a call any content that is sexually exploitative of minors, non-consensual, obscene, or otherwise illegal in your jurisdiction.
• Record, screenshot, stream, or redistribute any call without the express consent of all participants, except where the Service provides a built-in recording feature that both parties have agreed to.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Solicit payments outside the Service in order to circumvent platform fees.
• Attempt to reverse engineer, decompile, or interfere with the Service’s security, infrastructure, or normal operation.
• Use the Service for any unlawful purpose, including money laundering or fraud.

Violation of this section may result in immediate suspension or termination of your account, forfeiture of pending payouts, and reporting to law enforcement where appropriate.

Fans purchase credits or pay directly through the Service’s supported payment methods to book calls. All payments are processed by third-party payment processors, and you agree to their applicable terms.

"Call My Creators" retains a service fee (commission) from amounts earned by Creators, as disclosed in the app or in a separate Creator Agreement. Payouts to Creators are subject to identity verification, minimum payout thresholds, and standard processing times.

Except as required by law or expressly stated in our Refund Policy, payments for completed calls and purchased credits are non-refundable.

“User Content” means any profile information, images, audio, video, or messages you submit to the Service. You retain ownership of your User Content, but you grant "Call My Creators" a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display that content solely as necessary to operate and improve the Service (for example, thumbnails, profile previews, and quality/safety monitoring).

You are solely responsible for your User Content and for having all rights necessary to share it.

Video calls are private communications between participants. "Call My Creators" does not record calls unless a recording feature is explicitly offered and both participants consent, or where required for safety review, fraud prevention, or legal compliance, consistent with our Privacy Policy.

You are responsible for complying with applicable wiretapping, recording-consent, and privacy laws in your jurisdiction.

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms, harms other users, or exposes "Call My Creators" to legal liability. You may stop using the Service and close your account at any time through the app settings.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT CALL QUALITY WILL MEET ANY PARTICULAR STANDARD.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, "CALL MY CREATORS" SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING FROM YOUR USE OF THE SERVICE OR ANY INTERACTION WITH ANOTHER USER, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You agree to indemnify and hold harmless "Call My Creators", its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Service, your User Content, or your violation of these Terms.

We may update these Terms from time to time. Material changes will be notified through the app or by email prior to taking effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Guwahati, Assam, India.
